The second amendment of our most precious document, the Constitution of the United States of America seemingly guarantees the rights of the citizenry to possess and bear arms but it does not guarantee the right to bring arms to bear. Any person who takes the time to read the body of the constitution will understand that each of it’s rights and entitlements demands profound responsibility of the citizenry. It is unfortunate that the court must parse the phraseology while overlooking the intent.

Post revolutionary possession and ownership of weaponry was understood. The continental army could not exist without a private armory and a ready militia. It was simply a matter of dollars and sense. In a slave driven economy weaponry was deemed necessary to maintain the status quo and prevent riot and revolution.

Manifest destiny and the westward migration was in part dependent on a mobile and personal arsenal. The diffuse and scattered army provided little security for travelers and settlers of the vast new land. Our tumultuous, violent and vigilante beginnings necessitated a certain raw lawlessness.

These original rights should not be altered but they must be open to interpretation, regulation and appraisal in the light of history and the changing realities of the modern day. Abilene, Hays and Dodge City Kansas all adopted ‘no carry’ laws regarding lethal weaponry in the late 1800′s. This is a historical town fact and state right not open to high court speculation.

All rights must be weighed with an equal measure of responsibly. Anyone who brings arms to bear must endure the closest scrutiny. This must include the military and police. We have gone beyond the frontier days and lethal force should not be wonton. Talk of teachers and airline pilots carrying heat boggles the mind. Purchase and possession of lethal force must be monitored. The Treasury Department knows my fiscal worth down to the cent but it seems to ignore to a large degree the massive artillery of everyday America. I abhor all governmental intrusiveness, it is as uncomfortable as a rectal examination but the realities of casual armament and deadly criminality must be addressed.

I’m sorry to say but as it is written the second amendment seems to declare, “Give all the loyal and god fearing white guys the weapons and everyone else duck for cover.” I know this is how the NRA and trigger happy Dick Cheney reads this article of the Constitution. The unhappiest event will be that the Supreme Court deems this reasonable. Cities, townships and even entire states must be allowed to regulate as they see fit, even to the point of disamament or the counter point of conceal and carry. The Treasury Department (ATF) should be responsible for the maintenance of an accurate census of all weaponry. All should look to disarm the mentally impaired and the criminally disposed.
